Description

Since June 2017, when the latest edition of the Bankruptcy Law by Professor of Law at Aristotle University of Thessaloniki, Spyros Psychomanis, was released, two years have passed, during which new legislative, mainly, changes (laws 4491/2017, 4512/2018, 4549/2018, 4554/2018 and 4605/2019), as well as formulated scientific positions and problematic jurisprudence, have repeatedly disrupted the field of this branch of law, which has never experienced calmness, not even for a moment, after its radical revision in 2007. The "forgiveness" of the debtor, the discharge of the bankrupt from the remainder of his debts, the "privileges" of the employees, the changes in the special privileged position of the secured creditors, the restructurings of the distribution table, the completion of the gaps in the pre-bankruptcy process of "special administration", but also the multitude of changes in the "pre-bankruptcy" field of over-indebted natural persons (non-traders) and the abolition of the protection of their primary residence, were the issues that prompted the author to once again undertake the revisionist research spade, knowing, however, and warning the reader, that legislative changes - whether correct or not - will not cease, obliging the legal theory and practice to remain constantly vigilant.
